El juego responsable no puede ser el único motor de una regulación de juego online

Santiago Asensi, Managing Partner at Asensi Abogados, analyzes the evolution and current challenges of online gambling regulation in Spain.

Since its launch in 2012, Spain’s online gambling framework has evolved into a model focused almost exclusively on responsible gambling. While measures such as the joint deposit limit and the supplier registry strengthen player protection, the sector continues to be affected by advertising restrictions, the absence of new licenses, and the lack of development of new gaming products.

These limitations, together with the advertising ban, have fueled the growth of the illegal market, which operates with fewer controls, greater incentives, and easier access. In contrast, Ceuta and Melilla have become key hubs for the industry thanks to their favorable tax framework and institutional support. The article also reviews the regulatory experience in Latin America, with Colombia as a benchmark, and reflects on the transformative role of artificial intelligence in both the gaming sector and legal practice.
